These Terms & Conditions (“Terms”) govern your use of the website, digital products, online courses, and services provided by Sensory SMART OT Pty Ltd (“we”, “our”, “us”), including all material associated with The Regulation Hourglass™.

“The Regulation Hourglass™” (TRH)
A trademarked framework, digital program suite, and intellectual property owned and operated by Sensory SMART OT Pty Ltd.

“We / our / us”
Sensory SMART OT Pty Ltd.

“You / your / user”
Any visitor, purchaser, student, or user accessing our website or content.

“Digital Products”
Includes online courses, webinars, PDFs, digital downloads, templates, videos, training materials, and all TRH resources.

“OT Course”
Refers to The Regulation Hourglass™ OT Course and any related professional training products.

 

2. Educational Purpose Only (AHPRA-Compliant)

All TRH frameworks, programs, and materials are provided for general educational and informational purposes only.

Our programs:

  • are not occupational therapy

  • are not clinical intervention

  • do not replace professional assessment

  • do not create a therapist–client relationship

  • must not be used as personalised therapeutic advice

Nothing in our materials should be interpreted as medical, therapeutic, psychological, or diagnostic advice.

If you have concerns about a child, seek assessment from a qualified Occupational Therapist or health professional.

 

3. No Clinical Outcomes or Guarantees

In accordance with AHPRA, we do not guarantee:

  • developmental progress

  • behavioural outcomes

  • emotional regulation changes

  • therapeutic improvement

  • school or classroom changes

  • NDIS approval, access, or funding outcomes

  • eligibility under the Thriving Kids program

Your results vary based on your context, application, and environment.
TRH materials provide capacity-building education, not treatment.

 

4. Intellectual Property & Copyright

The Regulation Hourglass™ framework, including:

  • diagrams & icons

  • phase sequence

  • workshop slides

  • online course materials

  • videos, PDFs, and downloads

  • worksheets, templates, scripts

  • descriptions, explanations, concepts

  • branding & program names

…are protected intellectual property of Sensory SMART OT Pty Ltd.

You are granted a single-user licence only.

You may not:

  • share login details

  • give or sell access to others

  • screenshot or re-upload materials

  • distribute materials in groups, workplaces, or commercial settings

  • claim TRH content as your own

  • train others in the TRH framework

  • use TRH materials in your own courses, workshops, or paid services

  • create derivative frameworks

Unauthorised use may result in:

  • revoked access (without refund)

  • legal action

  • termination of all accounts

 

5. Purchasing & Payment

By purchasing any Sensory SMART OT Pty Ltd or TRH product, you agree that:

  • All sales of digital content are final

  • No refunds will be issued for change of mind, non-use, or misunderstanding

  • Payment plans must be completed in full

  • Courses may be delivered as drip content

  • Access may be paused for failed or overdue payments

  • Prices and inclusions may change without notice

Payments are securely processed via Kajabi, Stripe, and/or PayPal.

 

6. Refund Policy

Digital products cannot be “returned,” therefore no refunds are issued except where required under the Australian Consumer Law.

Refunds may be considered only if:

  • duplicate purchases occur under the same email

  • a major technical fault on our end prevents access

NDIS funding changes, personal circumstances, changes of mind, or perceived lack of outcomes do not qualify for refunds.

7. Account Access & Security

You must:

  • provide accurate information

  • maintain confidentiality of your login

  • not share logins with colleagues, friends, schools, or workplaces

If login-sharing is detected, access will be revoked immediately without refund.

We reserve the right to suspend or terminate access for:

  • breach of Terms

  • inappropriate behaviour

  • misuse of content

  • failure to complete payment plans

  • copyright infringement

 

8. Course Availability & Updates

The Regulation Hourglass™ OT Course may be updated, improved, or expanded at any time.

We do not guarantee lifetime access unless explicitly stated.
If lifetime access is included, it refers to the lifetime of the program, not the user.

We reserve the right to retire or archive courses.

 

9. External Links

The Website may contain links to external platforms.
We are not responsible for:

  • third-party content

  • accuracy

  • availability

  • privacy practices

Use external links at your own discretion.

 

10. Privacy & Data Collection

We collect personal information only for:

  • delivering digital products

11. NDIS, Thriving Kids & Policy Information

Sensory SMART OT Pty Ltd does not:

  • promise that course completion will influence eligibility

  • claim any affiliation with NDIA or government programs

Information provided is general only and may change as policy evolves.

 

12. Limitation of Liability

To the fullest extent permitted by NSW and Australian law:

Sensory SMART OT Pty Ltd is not liable for:

  • direct or indirect damages

  • financial loss

  • personal decisions made based on course content

  • device or network issues

  • changes to NDIS or government policy

  • loss of profits, income, or data

  • interruption of access

  • third-party errors or outages

Any non-excludable liability is limited to the minimum amount allowed under Australian Consumer Law.

 

13. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any disputes will be handled exclusively within NSW jurisdiction.
