Sensory SMART OT Pty Ltd
Including The Regulation Hourglass™ Framework & Online Courses

Sensory SMART OT Pty Ltd (“Sensory SMART OT”, “we”, “our”, “us”) provides online educational courses, digital resources, professional training programs and learning materials relating to paediatric development, emotional regulation, sensory processing and The Regulation Hourglass™ framework.

These products are provided subject to the terms of this Product Agreement.

By registering for, purchasing, accessing or participating in any course, program, membership, webinar, download or training provided by Sensory SMART OT Pty Ltd, you acknowledge that you have read, understood and agree to:

    • our Website Terms of Use
    • our Privacy Policy

If you do not agree with these terms, you must immediately stop using or participating in our products.

This Product Agreement may be updated from time to time. The most current version will always be published on our website.

Course Participation

Access to courses and digital products is provided on a single-user licence basis unless otherwise specified.

Your purchase allows participation by one individual user only.

Participants agree not to:

  • share login details with others
    • distribute course materials or downloads
    • allow unauthorised access to the course platform
    • reproduce course materials for organisations or teams without permission

We reserve the right to suspend or terminate access if login sharing or unauthorised distribution of course materials is detected.

Participation by third parties such as marketing agencies, content developers or external contractors for the purpose of copying or reproducing course materials is not permitted without written consent.

Educational Purpose

All courses, programs, downloads and resources provided by Sensory SMART OT Pty Ltd are intended for educational and informational purposes only.

Course materials are designed to support learning about children’s development, regulation and supportive environments across home, school and community settings.

They are not intended to replace individualised professional assessment, therapy or treatment.

Participation in a course does not establish a therapist–client relationship between participants and Sensory SMART OT Pty Ltd or its staff.

If you have concerns regarding a child’s development, behaviour, sensory processing or emotional wellbeing, you should seek guidance from a qualified health professional.

No Guarantees or Outcomes

In accordance with professional guidelines and AHPRA requirements, Sensory SMART OT Pty Ltd does not guarantee specific outcomes from participation in courses, programs or digital resources.

Children’s development and responses vary depending on many individual factors.

We do not guarantee:

  • behavioural changes
    • developmental progress
    • emotional regulation outcomes
    • school participation outcomes
    • therapy outcomes
    • funding eligibility (including NDIS or other programs)

Our programs are designed to support learning and capacity-building, rather than to provide treatment or guarantee outcomes.

Participants are responsible for determining how course information may apply to their own circumstances.

Digital Products and Course Delivery

Many of our programs are delivered as digital learning products.

These may include:

  • online courses
    • recorded video lessons
    • live webinars
    • downloadable resources
    • templates and worksheets
    • workbooks or guides
    • membership resources

Because digital products are delivered instantly and cannot be returned, purchases are generally considered final once access has been granted.

Payments

Some courses and programs are offered for a fee, while others may be provided free of charge.

If a fee applies, this will be clearly stated prior to purchase.

Payments may be processed through third-party payment gateways such as Stripe. Your use of these services is subject to their own terms and conditions.

Unless otherwise stated, all prices are listed in Australian dollars (AUD) and include GST where applicable.

You confirm that all payment information provided is accurate and that sufficient funds are available for the purchase.

If a payment is dishonoured or reversed after purchase, you must promptly rectify the payment.

Where payment plans are offered, participants agree to complete all scheduled payments associated with the program.

If payments become overdue:

  • course access may be temporarily paused
    • access may be restored once payments are brought up to date

Selecting a payment plan option commits you to complete the full purchase amount.

Refund Policy

Due to the nature of digital educational products, refunds are generally not available once access to course materials has been provided.

This policy aligns with common practice for digital learning products and with provisions of the Australian Consumer Law (ACL) regarding digital goods.

However, participants may be entitled to a remedy if a product:

  • is significantly different from what was described
    • contains a major technical fault that prevents access
    • cannot reasonably be repaired or resolved

Refunds are not available for circumstances such as:

  • change of mind
    • personal or family circumstances
    • choosing not to complete the course
    • choosing not to access course materials
    • changes to NDIS funding or eligibility
    • differences in individual outcomes or experiences

Intellectual Property and Framework Protection

The Regulation Hourglass™ framework and all associated course materials are the intellectual property of Sensory SMART OT Pty Ltd.

This includes but is not limited to:

  • the Regulation Hourglass™ framework structure
    • phase terminology and sequencing
    • diagrams, icons and visual models
    • teaching methodology
    • written explanations and learning materials
    • course videos and presentations
    • downloadable resources and worksheets
    • program branding and titles

Participants receive a limited licence for personal educational use only.

Course materials may not be:

  • reproduced or distributed
    • shared with colleagues or organisations
    • uploaded to third-party platforms
    • incorporated into other courses or workshops
    • used to create derivative training programs
    • presented as original work

The Regulation Hourglass™ framework may not be taught, licensed, or commercially delivered by others without written permission from Sensory SMART OT Pty Ltd.

Unauthorised use may result in termination of course access and may constitute copyright infringement.

Certification and Professional Representation

Participation in any Sensory SMART OT Pty Ltd course or program relating to The Regulation Hourglass™ provides educational learning only.

Completion of a course does not constitute certification, accreditation, or professional endorsement in The Regulation Hourglass™ framework unless explicitly stated.

Participants must not represent themselves as:

  • certified in The Regulation Hourglass™
    • accredited in The Regulation Hourglass™
    • an authorised trainer or provider of The Regulation Hourglass™
    • endorsed by Sensory SMART OT Pty Ltd to teach the framework

unless they have received formal written authorisation from Sensory SMART OT Pty Ltd.

Participants may state that they have completed a course or training relating to The Regulation Hourglass™ but must not imply formal certification or affiliation.

Sensory SMART OT Pty Ltd reserves the right to determine how the framework may be represented in professional or commercial contexts.

Derivative Frameworks and Adaptations

The Regulation Hourglass™ is an original framework developed by Sensory SMART OT Pty Ltd.

Participants acknowledge that the conceptual structure, phase sequence, terminology, visual models, and teaching methodology associated with The Regulation Hourglass™ represent the intellectual property of Sensory SMART OT Pty Ltd.

Participants may apply the principles and insights learned through the framework within their own professional practice when supporting children.

However, participants must not create, publish, or distribute derivative frameworks, training models, or educational programs that replicate or substantially reproduce the structure, phase progression, conceptual model, or teaching methodology of The Regulation Hourglass™, whether under the same name or a different name.

This includes, but is not limited to:

  • renaming the phases while maintaining the same conceptual structure
    • adapting the framework into another model for training or commercial purposes
    • presenting a modified version of the framework as original intellectual property
    • incorporating the framework into courses, workshops, books, or programs without  

   written permission

Any use of The Regulation Hourglass™ framework for training, consulting, licensing, or commercial purposes requires prior written permission from Sensory SMART OT Pty Ltd.

Responsible Use of Course Materials

Course materials are designed to support learning and professional reflection.

Participants are responsible for applying information appropriately within their own professional or personal contexts.

Sensory SMART OT Pty Ltd is not responsible for how course information is interpreted or applied in individual situations.

Organisational Use and Additional Licences

Courses and digital resources provided by Sensory SMART OT Pty Ltd are licensed for individual use only, unless otherwise specified.

Purchase of a course grants access to one individual participant only.

Course materials may not be used to train, supervise, or educate teams, organisations, or groups without the purchase of additional licences or written permission from Sensory SMART OT Pty Ltd.

If an organisation wishes to use course materials for staff training, team development, or organisational learning, please contact us to discuss appropriate licensing options.

Sensory SMART OT Pty Ltd reserves the right to request that organisations purchase appropriate licences where course materials are used in group settings.

Course Updates and Availability

Educational programs may be updated periodically to reflect new insights, improvements or developing practice.

Where possible, participants will benefit from these updates.

Access duration may depend on the availability of the program or platform.

While we aim to maintain access to purchased courses, we reserve the right to modify, archive or retire programs if necessary.

 

Technical Access

Courses are hosted on online learning platforms and require internet access.

We will make reasonable efforts to assist with technical issues related to:

  • login difficulties
    • broken links
    • course access problems

However, we cannot guarantee compatibility with every device, browser or network configuration.

Privacy

Sensory SMART OT Pty Ltd respects your privacy and manages personal information in accordance with Australian Privacy Laws.

Information collected may include:

  • name
    • email address
    • account information
    • course participation data
    • voluntary feedback or survey responses

Payment details are processed securely through third-party providers such as Stripe and are not stored directly by us.

Information may be stored securely using platforms such as:

  • Kajabi
    • Stripe
    • Google Workspace

Participants may unsubscribe from marketing emails at any time.

External Links

Our website may include links to external websites or services.

We are not responsible for the content, privacy policies or practices of third-party websites.

NDIS and Government Programs

Sensory SMART OT Pty Ltd and The Regulation Hourglass™ are independent educational services.

We are not affiliated with the NDIA, NDIS or any government program.

Information provided within our programs is general educational information and should not be interpreted as legal, funding or policy advice.

Completion of any course does not guarantee eligibility for funding or services.

Limitation of Liability

To the fullest extent permitted by Australian law, Sensory SMART OT Pty Ltd and its directors, employees, contractors and representatives are not liable for any loss or damage arising from participation in courses or use of course materials.

This includes:

  • personal decisions based on course information
    • individual learning outcomes
    • device or network issues
    • interruptions to platform access
    • changes to government policy or funding frameworks

Nothing in this agreement excludes rights you may have under the Australian Consumer Law.

Where liability cannot be excluded, our liability is limited to resupplying the service or to the cost of supplying the service again.

Respectful Learning Environment

Sensory SMART OT Pty Ltd is committed to providing a safe, respectful and supportive learning environment for all participants.

Participants agree to engage with course instructors and other participants in a respectful and professional manner.

The following behaviour is not permitted within courses, group programs, webinars, or online communities associated with Sensory SMART OT Pty Ltd:

  • harassment, intimidation or discrimination toward other participants
    • disruptive behaviour during live sessions or online discussions
    • sharing confidential information about other participants without consent
    • misuse of course platforms or communication channels
    • any behaviour that interferes with the learning experience of others

Sensory SMART OT Pty Ltd reserves the right, at its sole discretion, to suspend or terminate access to a course, program or community if a participant engages in behaviour that breaches these expectations.

Where access is terminated due to inappropriate behaviour, no refund will be provided.

Termination

Sensory SMART OT Pty Ltd is committed to providing a respectful learning environment.

We reserve the right to suspend or terminate a participant’s access to a course or program if they:

  • breach this Product Agreement
    • misuse course materials
    • engage in disruptive behaviour toward instructors or participants

Termination of participation does not entitle the participant to a refund.

Governing Law

This Product Agreement is governed by the laws of New South Wales, Australia.

If any part of this agreement is deemed invalid by a court of competent jurisdiction, the remainder of the agreement will remain in effect.
